The West Bengal government has not got any relief from the Supreme Court in the case of inclusion of 77 castes including Muslims in the OBC category. In fact, the Supreme Court has refused to stay the decision of the High Court. The Supreme Court asked the West Bengal government to provide within a week the details of the survey conducted to determine the social and educational backwardness of 77 communities before including them in the OBC list and data about their alleged under-representation in state government services.
What did the Supreme Court say in the hearing
Along with this, the Supreme Court also asked the state government to provide details of the consultation done with the State Backward Commission before including 77 communities in the OBC list. The Supreme Court heard the appeal of the West Bengal government against the May 22 decision of the Calcutta High Court. The Calcutta HC had quashed a series of state orders to include 77 castes in the OBC category during 2010-2012 (75 out of 77 were Muslims).
What was the decision of the High Court
The Calcutta High Court had given a big decision regarding the reservation of Other Backward Classes (OBC) in Bengal. In its decision, the court has canceled this reservation given to many classes in 2010. While giving the verdict, the court had said that giving such reservation in vacancies of services and posts in the state is illegal. This decision of the court is now being seen as a big setback for the Mamata government of the state. Mamata Banerjee had said about this decision of the court that she will not accept the court’s decision to cancel OBC status and OBC certificate.
